Bhoja Air Flight 213 Crash - Case Registered Against Airline Owner

According to DAWN News channel, upon receiving complaint from a man whose mother died in Bhoja Air crash near Islamabad Airport in 2012, a court has ordered registration of a case against owner and management of the airline.

The FIR has been registered at Lohi Bher Police Station, Islamabad, under sections 302, 427, 286, 287, 109, 120B of Pakistan Penal code.

On April 20, 2012, Bhoja Air Boeing 737-236 Advanced (AP-BKC) was performing flight B4-213 from Karachi to Islamabad when it crashed into a residential area called Hussainabad, some 6 kilometers away from Islamabad Airport around 6:40 PM local time. The aircraft was approaching Islamabad Airport Runway 30 for landing when it crashed. All 127 people aboard the aircraft, including 6 crew members, died in this accident. Weather was bad with rain and lightning at the time of accident.

BTW, incorrect flight number 123 is entered in the FIR.

The case has been registered against the owners, directors and shareholders of Bhoja Air (Pvt) Ltd, Farooq Omar Bhoja, Jet Aviation Sharjah, Arshad Jalil, and officers of the Civil Aviation Authority (CAA).

The FIR contains charges under Sections 109 (punishment for abetment), 120B (criminal conspiracy), 286 (negligent conduct with respect to explosive substance), 287 (negligent conduct with respect to machinery), 302 (qatl-i-amd), and 417 (cheating) of the Pakistan Penal Code (PPC).

Today, Bhoja Air crash afectees appeared before Supreme Court. They told the court that the investigation found airline and Pakistan Civil Aviation Authority (CAA) responsible for the accident. No action has been taken despite registration of FIR, the court was informed.

According to following news report, Islamabad High Court (IHC) has issued arrest warrants for nine people including owner and officials of Bhoja Air.

Today, the Supreme Court of Pakistan asked police to complete Bhoja Air crash investigation in six weeks and submit challan.

The court was informed by a lawyer that First Information Report (FIR) is not entered for military/civilian air crashes in Pakistan. The court remarked it can be started from this case.

The air crash investigation report by Pakistan CAA/SIB has been made part of court proceedings. The report blames Bhoja Air for criminal negligence.

CAA refuses to hand over Bhoja Air`s file to investigators, officials say

ISLAMABAD:
The Civil Aviation Authority (CAA) refused to cooperate with a special investigation team looking into the 2012 Bhoja Air crash, Dawn has learnt from of ficials close to the investigation.

Team members recently returned to Islamabad from Karachi, where they met with senior officials from the CAA`s Directorate Flight Standard, they said, who denied the investigators` request for afile containing details of Bhoja Air.

DFS is responsible for maintaining files related to airlines` applications to operate. They also keep records of aircraft htness, licences issued to airlines and certificates.

Bhoja Air flight B4-213 from Karachi to Islamabad crashed, shortly before landing at Benazir Bhutto International Airport, in the Husainabad village on April 20, 2012, killing all 127 passengers and crew members on board.

A criminal case was registered against various individuals including the owner of Bhoja Air with the Koral police, officials said, and a commission was constituted to investigate the crash under directions from the Islamabad High Court.

The commission`s report held the owners and staff of the airline responsible, along with CAA officials. Another casewas registered against those accused in the report,0fhcials said.

A senior officer told Dawn that a fourmember team was constituted, under the supervision of a superintendent of police from the investigations wing to look into the incident in light of the commission report. The team had been seeking the Bhoja Air file maintained by the DFS.

The details and documents from the file would help investigators identify those involved in the crash, he said.

`Investigators are focusing on the file, which is concrete evidence against those responsible.

The officer said that when investigators returned from Karachi they told senior ofhcials that they had been denied access to the file and handed the matter over to the Special Investigation Team.

The chairman of the team will serve anotice on the director general of the CAA, asking him to appear before the team and produce the ble,he said.

Another officer close to the investigation said that warrants for nine suspects, including the chairman, chief executive, director, managing directors, director north, chief finance officer, marketing director, MIS director, engineering director and operations director of Bhoja Air had already beenissued.

Of the total, five have lef t Pakistan, but the ofhcer said they had been declared proclaimed offenders and efforts to issue their red warrants from Interpol had also been initiated.

Other four have obtained bail and a hearing in this regard was scheduled in Islamabad`s lower courts, he said.
