PIA contradicts report about management meeting

Defence Minister Chaudhry Ahmed Mukhtar has not called the PIA management to Islamabad, as the defence minister is not present in Islamabad on August 2. A PIA spokesman said in a press release on Monday.

He said that news item appearing in The News and Daily Jang on August 2, 2010 titled: “Mukhtar calls PIA bosses, pilots for talks” is incorrect. Besides, there is no ‘tiff’ between the PIA management and Palpa over flight safety issue as mentioned in the same story. The Palpa president and few of the executive members are pursuing illegal go-slow causing unnecessary delays and cancellation of flights and inconvenience to passengers.

The PIA spokesman said that there is no such CAA order as ANO-IV; the relevant order of Civil Aviation Authority (CAA) is Air Navigation Order 12. The duty timings of Captain Juniad Younis and First Officer Sajjad Gul have also been wrongly mentioned. PIA cannot force any pilot to fly; in fact no administrative action may be taken against the pilot if he refuses to operate the aircraft even at the last minute.

He said during the last two weeks Palpa President Captain Sohail Baluch and members of the executive committee have refused roster of flights while others reported sick. Captain Sohail gave a non-professional excuse that he was busy in Association activities so he will not operate the scheduled flight.

The PIA spokesman said that the Air Navigation Rules prescribed by the CAA state that the rest hours of the pilot and crew is of twice the duration of the flight time of previous flight and not less than twelve hours. It is important to note that PIA provides rest to its pilots and crew in excess of this minimum stipulated rest.

The PIA provides 48 hours of rest to its pilots after the flight duty timing of fifteen hours and almost twenty-four hours of rest after a flight of ten hours.

It is pertinent to mention here that Federal Aviation Administration (FAA) has the prescribed flight duty time of twelve hours with one pilot and First Officer, which is being followed by the airlines operating in America and other countries. Whereas, according to Joint Aviation Requirement (JAR OPS) followed by all the airlines of the Europe, the flight duty time of a single pair of crew is thirteen hours. The CAA has allowed the airlines in the country to operate a flight with single pair of crew for the flight duty time of twelve hours but PIA has further relaxed the flight duty time up to ten hours, the spokesman added. No headway in meeting on PIA-pilots row

A tripartite day-long meeting on ticklish issues in the Pakistan International Airlines Corporation (PIAC) on Monday made no headway as all the parties remained stuck to their guns.

The meeting held at the Defence Ministry, however, discussed all the matters including “violation of flight duty time limitations” and another round of this meeting is likely to take place today (Tuesday).

Additional Secretary-I of the Defence Ministry Maj Gen (R) Mir Haider Ali Khan chaired the meeting with Joint Secretary (Aviation) Arshad Farooq Faheem, DS (Flying), MD PIA Captain Aijaz Haroon, DFO PIA Captain Shuja Naqvi, GM (CP and S) PIA Captain Haroon Abdullah, President Pakistan Airlines Pilot Association (PALPA) Captain Suhail Baluch, General Secretary PALPA Captain TM Rabbani, Legal Adviser PALPA Shaikh Jawaid Mir and Joint Secretary-III PALPA FO Zahid attended the meeting.

The meeting was a continuation of July 31st meeting held in Karachi between the Defence Ministry, PALPA and PIA, and it was convened on the directions of Defence Minister Chaudhry Ahmed Mukhtar.

Insiders say that violation of flight duty time limitations was the key item on the agenda and the meeting observed that “the pilots’ rest is supreme and safety can not be compromised over revenue under any circumstances.”

The source said “the chair appreciated the PALPA’s efforts and its concerns to ensure safety. However, any motive other than that from either side shall not be encouraged. In order to resolve this issue, it has been considered necessary that the ANO-12, Issue-4 (abbreviation as ANO-IV) has to be revised.”

The meeting decided to form a committee by the Defence Ministry as DDG HQs CAA (Chairman) and representative of department of flight standards, PIA, PALPA and private airlines operating in Pakistan.

The meeting also discussed Bahrain incident, seniority issue, violation of Article-3 of PALPA working agreement 2009-2010 by PIA management and contractual employment of pilots. This was decided to keep this issue pending till finalisation of some steps to be taken by the PIA.

These steps include; (1) the PIA management will finalise its expansion forecast in the light of its business development plan; (2) The management will work out its career plan for regular pilots of PIA; (3) The management will come out with the exact requirement of pilots to be employed on contract basis along with the period/duration for which is required; (4) This exercise will be completed by the management in active consultation with PALPA within a maximum period of one month and on its basis, the Defence Ministry will then workout the criteria for selection and terms and conditions of the contract.

PIA-PALPA dispute: ministry summons representatives

KARACHI (August 04 2010):
The Ministry of Defence (MOD) has summoned top management of PIA and representatives of Pakistan Air Line Pilots' Association (PALPA) to Islamabad to cool down tempers, and settle the disputes between the two, as it is resulting in flight delays, and has left passengers stranded at national and international airports.

Whether it was a human, navigational or procedural error, which caused the tragic AirBlue Airbus crash last week in Margalla hills has yet to be determined by the investigators, the incident apparently forced the Ministry to intervene at the highest level to avoid possible tragedy of the kind in the interest of the travelling public.

Till the time of filing of this report both the management and the pilots were sticking to their respective stance, and none was willing to step back, especially on Flight Duty Time Limitation, a clause in the working agreement, which the pilots assert is not being followed. Minister of Defence Ahmed Mukhtar had sent his representative, a Joint Secretary of the Ministry, last week to Karachi to find out details of the quarrel, which had brought the pilots and the management of PIA at loggerheads.

The Joint Secretary, according to sources, conducted extensive marathon sessions with the two, but failed to bring them to a table together for conversation. Later, he presented a report to the Defence Minister, who has called both parties to Islamabad.

A PIA spokesman said in a statement that Air Navigation Order issued by Civil Aviation Authority (CAA), prescribing rest for pilots, is twice the duration of the flight time of the previous flight and not less than 12 hours, while PIA provides rest to its pilots, and crew, in excess of this minimum stipulated time, ie 48 hours, after a flight of 15 hours, and 24 hours after a 10 hours' flight.

However, the PALPA had been voicing concern over the working conditions of pilots in PIA and also highlighting the waivers given by Civil Aviation Authority to PIA over operating flights against safety standards violating the CAA's Air Navigation Order ANO 4 and PALPA-PIA working agreement.

Globally, the airline pilots negotiate with their management's some relaxation's extending flight duties beyond respective CAA's prescribed rules, which are stricter and do not allow flights by pilots beyond prescribed limits. But the pilots, through their associations, agree for some waivers in flights exceeding time limits in exchange of monetary benefits or other perks. Similarly, the PIA pilots entered into an agreement with the management on 17th November 2009, after deliberations of more than one year.

"The pilots' salary slips inflate with as much of flying as he does, but here we are asking for strict implementation of the agreement management signed with us. We have given 24 waiver flights to the management but they continue to be cunningly irresponsible on flight duty times and sending short-rested pilots on flights and threaten them of dire consequences, if they refuse," a spokesman of PALPA told Business Recorder.

"The pilots are the last line of defence, in technical terms. Therefore, world-wide they are governed with strict rules and are made to observe the rules, as passengers' lives depend on their one single mistake," he said.

"A human error, often referred to in case of mishaps, does not necessarily be of the pilot only; there is a chain of humans involved that could contribute to a crash, from Engineer, who checked and cleared the aircraft to fly, to the one who was in Control Tower uptil the one observing Radar.

The human factor also involves the management of the airline and the CAA," stated a former air crash investigator. He said that besides the weather and runway's surrounding conditions (no-fly zones, etc) one should also take into consideration the working environment, which gives mental stress, or relaxation, which is the most critical aspect.

The former investigator said that there had been several incidents in the world of aviation where the investigators had put the blame on management's, and aviation authorities, for not following the Air Safety Standards. "In Pakistan, we are witnessing the same debate these days".

He was of the opinion that the quarrel between the national flag carrier and its pilots, which started even before July 28, the day the AirBlue aircraft crashed, gives an ample example of importance being given to air safety by the authorities. "It is amazing that a high level official took 10 days to notice it".

PIA has accused PALPA of causing a billion rupees loss in a few days due to illegal go-slow campaign in which around 70 pilots and first officers refused to do scheduled flights, including some of the PALPA office-bearers. While refuting the management's claim, the PALPA spokesman said that the rosters for August were given to pilots only on July 31.

"As most of the pilots were abroad, they were unable to find out their flights of next week. This is just one example of ill planning. Moreover, the rosters are full of errors and fail to provide stipulated rests to pilots between flights, let alone the mandatory 10 days' off, required as per international standards. He said that senior Boeing 777 captains are doing 24-28 days' duties in a month, which is against international safety standards, PALPA-PIA working agreement and, above all, CAA's Air Navigation Order Issue 4.

Ministry settles PALPA issue to end pilots go-slow

ISLAMABAD (APP) -
Ministry of Defence has finally settled the issue raised by PALPA for which they were resorting to Go-Slow during the last three weeks.

According to official sources, Ministry of Defence has desired that PIA management as well as Pakistan International Airlines Pilot Association (PALPA) would demonstrate utmost commitment to make airline a vibrant entity for giving its best to the customers and shall strive to continue general good for the people of Pakistan.
The issues settled are as follows:

— Bahrain incidence - Fresh inquiry would be initiated against Flight Steward by a three member committee constituted by Ministry of Defence. PALPA representative shall be allowed to attend the inquiry proceedings as an observer.

The inquiry shall be conducted under PIA Employees (Service and Discipline) Regulations 1985 as amended up to date.

— Seniority issue - With respect to pilots inducted before 2001 stands settled / finalised and conclusive. While in respect of pilots inducted after 2001 the issue will be decided by a committee which will include representatives of Ministry of Defence as Chairman with a representative of PIA management and PALPA each.

— Pension issue - To resolve the issue another committee has been constituted with Secretary Finance / Representative as Chairman, and the members shall be Secretary Defence/ Representative, Chief Financial Officer PIA and PALPA Representative.

The said committee shall finalise its recommendations by 30th September 2010. On the recommendation of MD PIAC, it has been agreed that the formula decided by the above said committee shall form the basis for rest of the service / cadres of PIAC.

— NS-1 Ticket for pilots - It has been decided that all bookings in this category shall be confirmed in the economy class and once on board the Captain shall accommodate the ticket holder subject to availability.

— Flight Duty Timings Limitations - To resolve this issue, it has been considered necessary that ANO-12, Issue IV has to be reviewed. For the said purposes, following committee shall be constituted by Ministry of Defence.

DDG Head Quarters CAA (Chairman), members shall be Representative of Department of Flight Standards HQ CAA. Representative of PIAC, Representative of PALPA and a Pilot Representative of a Private airline in Pakistan.

This committee shall revise ANO-12, Issue IV within 1 month and submit the same for final approval of Ministry of Defence.

— Violation of Working Agreement - The management and PALPA will strictly abide by the working agreement 2009-2010. No retaliatory/ punitive action would be taken against any PALPA member by PIAC Management / PALPA with regard to the current disputed issue and any show cause notice/explanation asked for be unconditionally withdrawn. However, disciplinary action will be taken against any pilot violating the above mentioned agreement henceforth.

— Contractual Employment of pilots - On this issue the committee decided to pend the issue till finalisation of the following exercise.

(i) PIAC Management shall finalise its expansion forecast in the light of its Business Development Plan.

(ii) PIA Management / PALPA will work out its promotion/progression Plan for regular pilots of PIAC.

(iii) PIA Management will come out with exact requirement of pilots to be employed on contract basis along with the period / duration for which it is required in consultation with PALPA. Mod will then work out the criteria for selection and the terms and conditions of the contract and insure its implementation.

The Ministry of Defence meeting concluded that in case of any misunderstanding / misinterpretation of clauses of working agreement such issues shall be resolved by PIA Management and PALPA with mutual understanding and negotiations (Under the general norms of goodwill and decency).

Flight safety standards probe ordered

KARACHI (August 12 2010):
Ministry of Defence has taken a strong note of the clauses of Air Navigation Order (ANO), issued by the Civil Aviation Authority (CAA), which provides undue space to operators when it comes to flight duty time limitations.

According to details, available on Wednesday, of the meeting held with PIA's management and Pakistan Air Line Pilots' Association (PALPA) in Islamabad last week, officials also ordered probe into the waivers given by the CAA to PIA over operating flights against safety standards violating CAA's ANO 4 and PALPA-PIA working agreement.

Secretary Ministry of Defence and officials of the aviation wing made it clear to the national flag carrier PIA's management that air travel safety should not be compromised and rules which violate such measures be reviewed.

During the meeting, which was held to review the irritants and cool down tempers between the pilots and PIA management, the ministry's officials appreciated pilots' concern over violation of air safety in Pakistan and termed it a top priority of the federal government to ensure measures to provide maximum comfort to commercial passengers using Pakistani airlines for inland and foreign travel.

PALPA members, it is learnt, did not compromise on their respective stance on flight safety and stood firm on the clauses of the working agreement, which according to the pilots are consistently being violated by PIA's management, particularly the clause on flight duty time limitation. The pilots were engaged in war of words with PIA's management only because of its principled and unwavering stand on air safety.

In technical terms, pilots are the last line of defence. Therefore, world-wide they are governed with strict rules and are made to observe the rules, as careless pilots pose threats to passengers' lives. A human error, often referred to in case of a mishap, does not necessarily be that of a pilot only as there is a chain of people involved that could lead to a crash.

From an engineer, who checked and cleared the aircraft, to the one who is posted in the control tower up till the one observing the radar, are all part of that chain. The human factor also involves the management of the airline and the CAA that creates bad working environment, resulting in mental distress for pilots thus causing huge possibilities of safety perils.

In the light of uncompromising concerns expressed by PALPA over safety, Ministry of Defence took a few decisions in principle to broker reconciliation between PIA's management and PALPA on certain differences between the two, ie, a fresh inquiry would be initiated in the Bahrain incident in which a steward, who boasted of having the support of a political figure, had slapped the captain.

The seniority issue would be dealt with on merit. A committee has also been constituted to resolve the pension issue. It would finalise its recommendations by September 30 2010. The issue of No-Sub-One (NS-1) ticket for pilots was also discussed.

Ministry of Defence decided that working agreement 2009-10 would be implemented in letter and spirit. Furthermore it was formally decided to withdraw any show-cause notice/explanation issued against some PALPA members. The issue of contractual employment of pilots was also decided to be kept in pending till the finalisation of expansion forecast in the light of PIA's business development plan.

MD PIA Appeal PALPA to Cooperate in PIA Flood Relief Efforts

Lahore, August 16:
MD PIA Captain Aijaz Haroon has made an earnest appeal to the PALPA executive Committee to support in the airlines Flood Relief Operations 2010.

MD PIA said that in this time of colossal national calamity the fellow citizen of the flood affected areas are looking towards and waiting for help and support and each of us must rise to the occasion and make the people of Pakistan proud of the national flag carrier.

As a national duty PALPA must see to it that all it members attend to the flying duties especially for flight from international destinations as PIA has launched a massive program for bringing relief goods and food stuff from international destinations.

MD PIA hoped that the PALPA would respond positively in such a moment of national disaster for the sake of suffering humanity.

KARACHI: The Managing Director of PIA Capt. Aijaz Haroon has a habit of betraying from the commitments he makes, this time he has embarrassed not only his community and colleagues but a senior Govt. functionary none less than the Secretary Defence, this was stated in a press release issued from PALPA head office on Monday.

The statement said that the moment when MD PIA was giving his words for commitment to flight safety in front of senior officials of Ministry of Defence, his cronies of legal department were filing a case against PALPA for striving for flight safety.

The MD PIA instituted a case against Pakistan Air Lines Pilots Association in violation of the agreement guaranteed by the Ministry of Defence (MOD) this is high time when the Govt. should realize how a national asset is being ruined, President PALPA Capt. Suhail Baluch said.

Capt. Baluch said that the pilots have been demanding from the MD to streamline the flight operations department as inefficiencies to plan rosters have become a routine and every 2nd or 3rd flight is violating air safety standards thus putting passengers’ lives and airline’s image at risk. He said that our humble requests have fallen on deaf ears and resultantly the MD PIA is now threatening the pilots and asking them to perform duties beyond ANO limits even.

While appreciating the role of MOD for the settlement that was in the larger interest of the national carrier the PALPA President Suhail Baluch has appealed the high ups in Government to assess the role of MD PIA who is continuously creating an environment full of tension for employees, such an environment he said, is creating frustration among the workforce.

He said that the airline has suffered heavily because the vindictiveness and incompetence of the MD which is evident from the fact that he kept MOD officials and PALPA engaged for a week to divert the attentions and later filed a case in the court on same pretext. He said there is a need to change the negative mindset of the airline.

PALPA has been suffering ever since the incumbent MD took over. There have been numerous tumbling blocks, which the Executive Committee had to confront. Time and again, the MD and his team have backtracked on their commitment.

He said that agreements have been blatantly violated and the dates to implement or conclude issues have in variably been disregarded. He said the pilots simply want fair treatment in line with the agreement reached in 2009 and also the assurances given by good offices of the MOD.

Capt. Baluch assured the Ministry officials that PALPA stands fully committed to abide by the agreement signed in the MOD. However, he cautioned that in an event of such a court case, if lodged, PALPA may not be able to control the outcome or reaction of the pilots’ community.

He appealed to the Minister and Secretary Defence to take notice of the breach of agreement by MD PIA to prevent the situation from deteriorating.

PIA Management and Pilots in Another Row

A row between PIA management and pilots has emerged again just after PIA recovered from a three work by book ‘go-slow’ by pilots following the intervention of Ministry Defence (MoD). The MoD facilitated signing of an agreement between PALPA and President Capt. Suhail Baloch and PIA MD Capt. Aijaz Haroon and co-signed by Maj-Gen Mir Haider of Ministry of Defence as guarantor.

Matters already resolved came to the front page again when PIA management having signed an agreement at the MoD on August 6, files a suit 1263/2010 in the Sindh High Court through its GM legal on the same day, said spokesman of PALPA on Monday.

The suit seeks to claim recovery to the tune of Rs. 100 millions from the pilots and also challenges the already signed Working Agreement which became effective on 17 November 2009. This has created insecurity amongst the pilots, who viewed this as an attempt to incite them or create an uncertain situation and a gross violation of the agreement signed in the Ministry of Defence.

PIA pilots had gone on a work by book drive for three weeks which led to delays and cancellations of over 100 flights. The pilots had challenged the issuance of a new Air Navigation Order (ANO) by Civil Aviation Authority (CAA) on the recommendation of PIA, which sought to reduce the mandatory rest periods essentials for flight safety in variance to rest requirements that already existed.

PALPA has issued a flash signed by its General Secretary Capt. Rabbani, dated 14 August, advising the members of the new serious development and asking them to “follow your monthly rosters strictly – claim 10 off days every month – and operate flights with at least 12 hours written notice as per clause 3.15.1g of Working Agreement.

In just two years of this management there have been three go-slows by pilots and on go-slow by aircraft engineers. The airline losses have hiked to unprecedented levels of over Rs. 80 billion with liabilities of over Rs 75 billion.

When contacted to know the viewpoint, PIA spokesman said first pilots have violated the agreement and had gone for go slow. He said that honorable court has restrained pilots association PALPA not to take action against any cockpit crew member who wants to perform his duty in PIA.

The row between the Pakistan International Airlines (PIA) administration and the Pakistan Air Line Pilots Association (PALPA) has surfaced once again, causing a lot of inconvenience to passengers who suffer due to repeated flight delays, Daily Times has learnt.

The PIA administration and the PALPA office-bearers had reached an agreement to resolve all outstanding issues only weeks ago in the presence of senior officials from the Ministry of Defence. However, the accord proved short-lived, as both sides started levelling charges against the other a few days ago.

PALPA claimed that the legal department of the PIA was filing a case against pilots at the same time when the PIA managing director was giving his commitment for flight safety [to pilots] in front of senior officials of the ministry. PALPA President Captain Suhail Baloch told a news conference on Wednesday that there was going to be no compromise on flight safety rules, alleging that the PIA administration has a history of backing out of its commitments.

He said that the administration did not implement even the previous agreement. However, a PIA spokesperson said that the administration still stands by its agreement reached with PALPA office bearers in the ministry. He said that the PALPA high-ups used to issue show cause notices to their members who agreed to operate flights despite the decision of the association.

As the administration had filed a writ, the Sindh High Court barred the PALPA high-ups from issuing notices to their members, he said. “It is the third time in this year that pilots have observed a go-slow,” he said. The controversy has caused a lot of inconvenience to passengers, as it resulted in flight delays. In a past couple of days, various international and domestic flights have been cancelled and delayed.

Flights to Oslo, London, New Delhi and Kathmandu have been cancelled, while a Frankfurt-bound PK-733 took after a delay of almost 12 hours on Wednesday. Talking to Daily Times, a passenger on the PK-733 said that his entire schedule has been disturbed due to the flight delay.

He said that he had booked a train ticket from Frankfurt to Berlin for 252 euros, which will go to waste due to the flight delay, as he would not be able to catch the train.

ITF backs 'safety conscious' Pakistan pilots

The ITF (International Transport Workers’ Federation) today moved to back the Pakistan Air Line Pilots’ Association (PALPA) and endorse its efforts to ensure safety on PIA flights.

ITF general secretary David Cockroft today wrote to the Prime Minister and President of Pakistan in defence of PALPA, saying: “The ITF has been informed that the management of Pakistan International Airlines has filed a legal suit against PALPA, claiming that the association is harassing its members and persuading them not to work due to the personal motives of its Executive Committee. This claim is strongly refuted by PALPA. PALPA has also indicated to the ITF that it has serious concerns about safety being compromised in PIA’s operations.”

He continued: “PALPA has had a long association with the ITF and is a valued member of the ITF family of unions, sharing our common values of decent working conditions, professionalism, safety and security in the transport sector. It is the ITF’s experience that PALPA considers the safety of passengers and crew to be paramount, and has taken the initiative to promote this issue whenever possible. Indeed, as recently as last month, the association organised an ‘Aviation Safety Challenges and Strategies Seminar’ together with the International Federation of Air Line Pilots' Associations (IFALPA) to which it is also affiliated. The seminar was attended by one of the ITF’s Executive Board members and the President of IFALPA. It is clear to the ITF that the members of PALPA feel directly responsible for the welfare of those in their care.”

PIA-pilots row delays flights

With road and rail links already in doldrums, Pakistan’s air links are threatened by an unnecessary new row that has erupted between PIA management and the pilots, despite an agreement reached under the auspices of Ministry of Defense on 6 August.

Within last couple of days several domestic and international flights were delayed or cancelled due to the confrontation developed between both the parties. These individuals seem to be not bothered that Pakistan and its unfortunate people are facing a severe natural disaster including cutting of roads and rail links. Personal egos and pilot politics seem to have prevailed upon the PIA management to go to courts, a move which depicts lack of professionalism on the both sides.

It merits mentioning here that already rail and road links are suspended in the most parts of the country and delay and cancellation of the flights would double the problems of the passengers. Poor passengers who pay taxes and revenues to PIA and government are caught in between and there seems to be no end in this endless recurring cycle of flight disruptions in PIA.

On August 6, normal schedules were restored after three weeks of disruption following the go-slow by pilots. On 16 August PK-702 operated by Boeing 777, registration AP-BHW had to abort its take off at Manchester because of a Landing Gear Warning. PIA flight schedules already disrupted due technical delays. The new problem occurred when PIA after having a series of meetings held on August 2, to 6th August at Islamabad in the Ministry of Defense, signed an agreement, but filed a suit for injunction and damages against PALPA in Sindh High Court on the same day, through its GM Legal, in spite of having signed an agreement.

As a consequence the PALPA issue a flash signed by its Gen Secretary Capt Rabbani on August 14, informing the pilots of the new instigation with calls to work strictly in accordance with book. On August 17 an international flight from Lahore PK-751 bound for Oslo-Copenhagen was cancelled, while PK-733 from Lahore for Paris and Milan was delayed for over 24 hours because of pilot scheduling and rest requirements. On 18 Aug 4 domestic flights namely PK-365, PK-328, PK-328 and PK-396 were delayed because of pilot rest requirements, while another flight PK-369 was delayed for technical defects.

On the same date, 5 international flights PK-737, PK-211, PK-738, PK-7789, PK-738 and PK-215 were delayed for cockpit crew rest requirements. Till the filing of this report PIA had cancelled PK-368 from Karachi to Islamabad while 9 other flights were delayed for crew requirements and two flights for technical defects. The delayed flights on Thursday were PK-238, PK-730, PK-230, PK-216, PK-360, PK-7345 (Umra Flight), PK-397, PK-385, PK-389, PK-7346 and PK-7350.

The Court has passed an interim order stating that both parties shall act in accordance with law
and follow the working agreement
